Amazon is one of the largest names in retail. It is the number one platform for online shopping, with over 2.5 million active sellers on the site. To accommodate its ever-expanding customer base, Amazon has created a new way to make deliveries: Amazon Flex. Unfortunately, negligent, reckless and hurried Amazon delivery truck drivers often cause accidents. Amazon generally avoids liability for these accidents since drivers are independent contractors, not employees. If you were in an accident with an Amazon delivery driver in Los Angeles, contact Panish | Shea | Ravipudi LLP for a free consultation about your rights. You may need a lawyer’s assistance in holding Amazon responsible.

What Is Amazon Flex?

Amazon Flex is a ridesharing service that hires drivers at $18 to $25 per hour to deliver Amazon packages using their own vehicles. It allows Amazon to reach its customers faster with deliveries from regional shipping centers. It also offers a flexible work opportunity where drivers are independent contractors, much like Uber or Lyft – but instead of transporting passengers, Amazon Flex drivers transport packages.

Who Will Pay for Your Injuries If You Are in an Accident With an Amazon Courier?

California is a fault state, meaning if an Amazon Flex driver causes your accident, he or she will be liable for paying for your damages. Call the at-fault driver’s personal insurance for coverage first. This could be enough to obtain fair compensation. If not, you may have to file a claim with Amazon’s Commercial Auto Insurance provider. Going up against a conglomerate such as Amazon can be difficult as an individual. However, Amazon’s policy could provide greater coverage for your losses. Amazon will only agree to pay for your losses if you can prove the driver was making an Amazon delivery at the time of the collision.

Insurance Coverage for Their Drivers

Amazon Flex’s FAQ page states that all drivers must carry personal coverage under California’s minimum requirements. These minimums are $15,000 per person in bodily injury, $30,000 per accident and $5,000 for property damages. In addition, Amazon gives all delivery partners free Amazon Commercial Auto Insurance, except drivers in New York. Amazon’s insurance provides auto liability coverage, uninsured/underinsured driver insurance, and contingent comprehensive and collision coverage. Amazon’s insurance only applies to drivers, not passengers, and only when drivers are making active deliveries.

How to Prove a Driver Was on Duty When the Accident Happened

Amazon will not use its Commercial Auto Insurance policy to cover victims’ damages if the driver was not in a delivery block at the time of the accident. As the victim of a collision with an Amazon delivery truck driver, you or your car accident lawyer will need to prove the driver was on duty to qualify for benefits outside of the driver’s personal policy. A delivery block is something the driver must sign up for with the Amazon Flex app. Amazon will then confirm the driver’s request. The driver will be on duty when the delivery block window arrives.

It may be possible to prove that an Amazon Flex driver was on duty at the time of your auto accident through the use of the driver’s cellphone records. Accessing the driver’s interactions with the Amazon Flex app, for example, could prove the driver had signed up for a delivery block and was currently delivering a package at the time of your crash. An Amazon delivery truck accident attorney from Panish | Shea | Ravipudi LLP may be able to help you prove the delivery person was on-duty at the time of your car accident.
